[Section 3.03] # is hereby amended by deleting it in its entirety and replacing it with the following:

This [Section 3.07] does not relate to environmental matters, such items being the subject of [Section 3.19].

This [Section 3.9] expressly supersedes the repurchase provisions of any “Incentive Agreement” with respect to Incentive Units entered into by the Company and a Management Member prior to the Effective Date.

This [Section 3.2(f)] will survive the expiration of this Nineteenth Amendment.

[Section 3.1.5] (Co-Funded Development Plan) of the Agreement is hereby deleted in its entirety and replaced with the following:

This [Section 3.2(d)] will survive the expiration of this Nineteenth Amendment.

This [Section 3.2(e)] will survive the expiration of this Nineteenth Amendment.
